The Analisi Economica del Diritto (Economic Analysis of Law) program is designed to provide students with a critical and rigorous understanding of the efficiency of norms and the effectiveness of their execution. The program utilizes microeconomic concepts, such as strategic choices, opportunity costs, and efficiency, to evaluate rules and legal norms.

Description

The program's primary objective is to promote a critical and rigorous vision among students regarding the evaluation of the efficiency of norms and the effectiveness of their execution. The course covers various topics, including:

• Efficiency and equilibrium: The example of cartel regulations
• The Coase Theorem, transaction costs, and juridical-economic scarcity
• Tradable permits and the market for human organs
• The governance of common resources ŕ la Ostrom
• Efficiency in protections (inhibitory protection vs. compensatory protection) and optional law
• Civil liability: efficiency, equilibrium, and errors
• Contracts (incomplete) and protection of specific investments (vs. protection of market competition)
• Enterprise hierarchy and variety of capitalisms

Objectives

The program aims to analyze the effects of norms on individual and enterprise behavior, as well as on the allocation of scarce resources. This is achieved by examining the influence of rules, such as property rights, contracts, and civil liability, on the overall performance of the economic system.

Teaching Methodology

The program is taught in-person and features a multidisciplinary approach, with a focus on national and international case studies. Students are encouraged to participate in self-assessment exercises provided by the instructor during the semester.

Examination Method

The examination is written and consists of three questions that may be open-ended, exercises, and/or comments on norms and propositions. The evaluation considers both the completeness and originality of the response, as well as the ability to provide a well-argued and personal thought.
