Theory of Argumentation and Informal Logic for Lawyers
Presentation
In the professional practice of Law, it is necessary to become familiar with concepts and tools of informal logic, fundamentally for the analysis and evaluation of legal arguments. The purpose of this course is to offer the participant the concepts and tools of informal logic for the analysis and evaluation of arguments in the legal field, knowing the various forms of reasoning used in Law such as deduction, induction, abduction, among others.

Theme block
- Introduction to formal logic and informal logic: Logic, dialectics and rhetoric, the function of rhetoric and argumentation, Law and Constitutional State.
- Good arguments: Toulmin's argument model.
- Diagrams and argumentative schemes for lawyers: The Toulmin scheme, the Wigmore-Twining scheme and the Walton scheme.
- Types of arguments: Inductive, deductive, abductive, by analogy and by generalization. Review of cases and examples.
- Failed arguments, fallacies: Ad ingorantiam, post hoc, ergo propter hoc, petitio principii (circular), complex question, ad populum, ad misericordiam (pity), ad baculum (fear), ad verecundiam (author), ex populo (opinion) and ad hominem (against the person), types and impact. Review of cases and examples.
Teachers
Pamela Lastres Dammert
Peru Doctor in philosophy from the University of Salamanca and the Pontifical Catholic University of Peru (mention: outstanding cum laude), master's degree in philosophy from the PUCP and degree in philosophy from the PUCP. She is a full-time regular professor in the philosophy section of the Department of Humanities of the PUCP and coordinator of the Logic course in the General Studies Letters of the PUCP. She is a member of the steering committee of the Latin American Association of Analytical Philosophy (ALFAn) and the advisory council of the UNESCO Network of Women Philosophers of Latin America. She collaborates as an advisor to the PUCP Rectorate. His main areas of work are analytical epistemology and informal logic. He specializes in the philosophy of the second Wittgenstein and has several publications on the late work of this contemporary thinker. He has co-edited the book Essays on Evidence, Argumentation and Justice (2016).
César Higa Silva
Peru Lawyer from the Pontifical Catholic University of Peru PUCP. Master in Legal Argumentation from the University of Alicante and Master in Law with a mention in Constitutional Law from the PUCP. He has carried out a research stay at the World Trade Institute attached to the University of Bern, Switzerland (2012) and at the Chair of Legal Culture at the University of Girona. Author of the books litigation, theory of the case and argumentation and motivation, evidence and judicial decision. He has participated with various presentations at the Conference of the Latin American and Caribbean Association of Law and Economics (ALACDE) and in the various Latin American Meetings of Legal Epistemology. He has also published various articles in academic journals.
Among other universities and institutions, he has been a professor at the Pontifical Catholic University of Peru, the University of Lima, the San Martin de Porres University and the AMAG Academy of Judiciary in courses related to Legal Argumentation, Evidentiary Reasoning and Theory of Evidence.
He is a partner of the consulting firm EvidenceLab.
