DIRITTO INTERNAZIONALE PRIVATO E PROCESSUALE

Course Description

The course represents an in-depth study of the themes of private and procedural international law, with specific reference to current issues.


Objectives and Contents

Educational Objectives

The objective of the course is to study the community rules, supranational guarantees of civil procedure, and private international law in matters of civil liability and contracts.


Detailed Educational Objectives and Learning Outcomes

The course aims to critically analyze the multiple sources in force in the Italian legal system in matters of international civil procedure and private international law, in light of the orientations of the doctrine and jurisprudential cases.


Prerequisites

Knowledge of basic private international law (mechanisms and sources), typically acquired through the course of international law.


Teaching Methods

During frontal lessons, the discipline of the subject will be reconstructed and systematized, frequently referring to jurisprudential cases. Students will be constantly involved in the analysis and discussion of cases.


Program/Content

The course will cover the following topics, both from the point of view of international civil procedure and private international law:


  1. Family relationships in private international law (in-depth study of European regulations on the dissolution of marital bonds, filiation, successions, and registered partnerships).
  2. Private international law of the internet (practical analysis of jurisdiction, choice of law, recognition, and enforcement of judgments in the context of online activities).
  3. Limits of public policy and mandatory rules (analysis of national and European jurisprudence that outlines the characteristics of these limits in the context of recently emerging cases).

Exams

Examination Method

The exam is held orally and consists of three questions. The Examination Commission is appointed by the Department Council and includes the lecturer. Students must register electronically for the exam within the prescribed times.


Assessment Method

The oral exam aims to verify the acquisition of in-depth knowledge by the candidate in relation to the topics covered by the course. The evaluation of the oral exam also takes into account the modalities of verbal exposition of concepts, including the use of appropriate legal terminology, as well as critical reasoning and personal re-elaboration capabilities.
