Course Description
The distribution of scarce rights by the government has become a central legal issue in recent years. New jurisprudence and developments in EU law mean that governments, lawyers, and jurists are increasingly confronted with complex choices and demands surrounding allocation procedures.
Key Questions
- Can a scarce permit still be granted without a public procedure?
- How do you determine the duration of a scarce right?
- What freedom does an administrative authority have in choosing an allocation method?
- And how far does the obligation to transparency extend in private law government actions, such as land allocation?
Course Objectives
This one-day course provides a clear and structured overview of allocation law, with an emphasis on current jurisprudence and legal bottlenecks. The course covers the relationship between national law and European law and discusses both public and private law allocation situations.
What You Will Learn
After completing this course, you will be able to:
- Determine when there is a scarce right in different legal contexts;
- Recognize, interpret, and apply relevant allocation norms;
- Indicate the differences between EU law and national law in the context of allocation;
- Argue to what extent public law norms also apply in private law allocations by governments;
- Legally substantiate which norms apply in unclear or new situations where jurisprudence is still developing.
Target Audience
This course is intended for lawyers and jurists working for governments who deal with administrative or private law aspects of allocation issues. Basic knowledge of general administrative law and government private law is assumed.
